Applicability

To the extent any content available through PornVoid is subject to 18 U.S.C. 2257, 18 U.S.C. 2257A, and the related regulations in 28 CFR Part 75, the required performer age and identification records are maintained by the custodian identified above or by a qualified non-employee custodian acting for the producer.

  • This site-wide page is intended as a compliance reference and contact point.
  • Matter-specific statements, placement, and display requirements must still be handled where the regulations require them.
  • Material that qualifies for a lawful exemption should be treated as exempt only where that exemption actually applies.

Records Location and Format

Required records should be maintained at a physical street address where they can be made available, and should be organized so they are retrievable by performer name and by title or other identifier of the relevant matter.

  • A post office box does not satisfy the street-address requirement described in 28 CFR 75.6.
  • Records may be maintained in hard-copy or digital form, provided the records can be authenticated and produced as required.
  • The operator should ensure that licensors and production partners deliver age and identity documentation before publication of covered material.

Retention and Inspection

Records required by 28 CFR Part 75 should be kept for the period required by law and made available during normal business hours to authorized government investigators in accordance with the regulations.

  • Under 28 CFR 75.4, records generally must be maintained for seven years from creation or last amendment, and for five years after business cessation in the circumstances described by the rule.
  • Internal handling of these records should be limited to trained personnel with a legitimate compliance need.
